Deciding to divorce is never easy. There is a lot to think about -- child custody, child support, division of assets, etc. One thing that soon-to-be ex-couples may not think about is how the state they live in handles divorce. Every state has their own divorce laws and it's probably a good idea to get familiar with your state's laws before moving forward with your divorce.
First, find out when the assets are classified as material. Some states consider the date that the divorce papers are filed in court to be the cut-off date for accumulation of marital assets, but other states set a mandatory 90-day period. This gives the judge a chance to render a decision and consider all marital assets until the divorce is final.

Contentious custody battles are hard on a family, but when you are former National Football League star, the media scrutiny can add to the stress of the situation. This has been the case for Deion Sanders when a judge ruled this week that Sanders' estranged wife must stay at least 500 yards away from him and also granted him temporary custody of the couple's children.
An incident last month spurred the latest legal battle as Sanders said that his wife and a friend attacked him in front of his children. His estranged wife denies the allegations and has said that her husband attacked her and she sustained injuries.

A victory for the ex-wife of the late millionaire Milton I. Schwartz means that she will receive a $420,000 lump sum alimony payment instead of monthly payments for seven years.
The case, which went all the way to the Nevada Supreme Court, was being challenged by the estate of Schwartz because they did not agree with the one lump sum alimony payment. In the original divorce proceedings, the ex-wife was to receive $5,000 a month for seven years.

Even though Michael Jackson died almost three years ago, there is still a lot of media attention surrounding his life and the children that he left behind. It was reported last week that a former bodyguard is filing legal paperwork to prove paternity of Jackson's youngest son.
According to the court filing, the man was a body guard for Jackson when he was in the United Kingdom. The man claims to have donated sperm to Jackson in London a year before the boy, Prince Michael Jackson II, also known as Blanket, was born in 2002. He is willing to provide a DNA sample to confirm his paternity claim.

Evading a court-ordered obligation is never a good idea and that was the case of an Indian Hills, Nevada, father who was sentenced to probation and ordered to pay back approximately $50,000 in back child support. The father admitted that he hadn't paid child support since 2005.
In the court filings, the father, 31, admitted to the court that after an injury, he became addicted to marijuana, Oxycontin and methadone and because of this; he did not meet his obligation of child support. His attorney did not know of his drug addiction and had been working on a repayment plan with the father.

You may be divorced from your ex-spouse, but it doesn't mean that you won't see or talk to that person again, especially if you have shared custody of your children. Dennis Rodman's ex-wife is suing him for owing her over $860,000 in past-due child and spousal support. Rodman's attorney said he has made some payments and that he will fight to overturn the contempt of court finding from last November's court appearance for not paying his child support. He appeared in court this week for his sentencing hearing in the matter; however his sentencing was postponed until late may.
Mr. Rodman's attorney said the NBA star owes much less than his ex-wife is claiming, if he owes anything at all. They will file a motion to vacate the contempt filing because, she says, it has not even been determined that he is behind and she will provide evidence to the family court judge of his payments.

While divorce is never easy, dealing with child custody issues can be harder. And for one woman, her child custody issues led her to break the law when she took her child from his elementary school and fled to Reno, Nevada.
An Amber Alert was issued last week and the 9-year-old boy was found with his mother the next day. The black Mercedes that authorities believe the mother was driving was later found and towed away by police. The boy was unharmed and his mother is in custody pending charges.

When a couple decides to have children both participate in the lives of their children, but if the couple divorces, a custody dispute may come into play. The courts tend to favor the mother in custody arrangements, so fathers may need to step up their involvement with their children's school if they want a chance at full custody or more visitation rights.
If you have school aged children, one way for you to help your case is to become more involved in your children's education. In recent years, this area is being looked at more as a factor in child custody cases.
